South Africa has a strong legal framework aimed at protecting women against discrimination and promoting equality in the workplace. Despite these protections, women continue to face challenges such as unequal pay, pregnancy discrimination, harassment and unfair treatment when returning from maternity leave.
The Employment Equity Act prohibits unfair discrimination in the workplace, including discrimination based on sex, gender and pregnancy. It also provides for the principle of equal pay for work that is the same, substantially the same or of equal value. While differences in remuneration are permitted in certain circumstances, these differences must be based on fair and rational factors such as experience, qualifications, seniority or performance.
